There are five classifications for employment-based immigration.
EB-1 Priority workers
- Individuals with extraordinary ability in the sciences, arts, education, business, or athletics
- Outstanding professors or researchers
- Managers and executives transferred to the US
EB-2 Professionals with advanced degrees or persons with exceptional ability
- Individuals with exceptional ability in the sciences, arts, or business
- Professionals with advanced degrees
- Physicians intending to practice medicine in underserved areas
EB-3 Skilled or professional workers
- Professionals with bachelor's or equivalent degrees
- Skilled workers with at least two years experience
- Unskilled workers
EB-4 Special Immigrants
- Religious workers
- Employees and former employees of the US Government abroad
EB-5 Immigrant Investors
- Engaging in or starting up a new commercial enterprise in the U.S.
- Showing that the new enterprise will either directly or indirectly create 10 or more jobs

Requiring PERM Labor Certification
Most foreign nationals immigrating to the United States on the basis of employment require that their employers file a request for labor certification on their behalf. The employer is the petitioner for the case. The alien employee is the beneficiary of the application. This is also called employer sponsored immigration.
New PERM regulations came into effect in 2005. Under these regulations, Labor Certifications are accepted electronically and processed within months. For the details of this PERM application, please visit the Department of Labor's website.

Exempt from PERM Labor Certification
The following is a list of occupations or positions held by a foreign national that would exempt his or her employer from the requirement of filing a labor certification.
- Multinational Employees who have been Managers or Executives for the employer or one of its subsidiaries or affiliates abroad for 12 months or more, and who will continue to work in a Managerial or Executive capacity in the United States.
- Outstanding Researchers and Professors. Defined as employees with a minimum of three years of research experience AND who have been published and cited in recognized journals in their field. Other outstanding achievements may also qualify.
- Employees of Extraordinary Ability. This category includes individuals with a high level of expertise who can demonstrate that they have risen to the top of their field.
- Employees who work in an occupation that is in the national interest of the United States. These employees must show that such interest would be harmed if the individual cannot remain in the United States.
- Schedule Occupations. At present, the government's exemption from labor certification designates only two occupations. Namely, registered nurses and physical therapists.
